These Terms of Service (the “Terms”) govern the legal relationship between:
Service Provider: Transfer.plus, E-mail: info@transfer.plus, (hereinafter the “Provider”) and User, meaning any natural or legal person using the Transfer+ service (hereinafter the “User”).
By using the Service, a contractual relationship is established between the Provider and the User in accordance with these Terms.
1. Description of the Service
1.1 Transfer+ is an online service that enables:
- uploading digital files,
- temporary technical storage of such files,
- sharing files via a unique link,
- downloading files by third parties.
1.2 The Provider acts exclusively as a technical hosting service provider within the meaning of Article 14 of Directive 2000/31/EC (eCommerce Directive) and applicable Czech and European Union law.
1.3 The Provider does not create, modify, review, monitor, or select the Content uploaded by Users.
2. Definitions
- Content – any file, data, information, or digital material uploaded by the User.
- Account – a registered user profile.
- Link – a unique URL enabling access to Content.
- Plan – a free or paid version of the Service.
3. Acceptance of the Terms
3.1 By using the Service, the User:
- confirms legal capacity to enter into contracts,
- agrees to these Terms,
- acknowledges their binding nature.
3.2 Failure to accept these Terms excludes the use of the Service.
4. Registration and Account
4.1 Registration is a mandatory condition for any uploading of Content to the Service.
Without registration, it is not possible to upload, store, or share files via the Service.
4.2 The User is responsible for:
- the accuracy of provided information,
- safeguarding login credentials,
- all actions performed through their Account.
4.3 The Provider is not liable for misuse of the Account by third parties.
5. Content and User Responsibility
5.1 Ownership of Content
All Content remains the exclusive property of the User or the respective rights holder.
5.2 Responsibility
The User:
- bears full and exclusive responsibility for the Content,
- represents that they hold all necessary rights to the Content,
- is liable for all legal consequences arising from uploading or sharing the Content.
5.3 Prohibited Content
Uploading Content that:
- violates applicable laws,
- infringes intellectual property or personal rights,
- contains malware, viruses, or harmful code,
- breaches sanctions or export control regulationsis strictly prohibited.
6. Provider’s Status (Hosting / Safe Harbour)
6.1 The Provider:
- does not perform prior review of Content,
- is not responsible for the legality of Content,
- bears no liability for damages caused by the Content.
6.2 The Provider is liable only to the extent required of a hosting service provider under European Union law.
6.3 The Provider enables the reporting of potentially unlawful Content through the “Report” feature available on the Service pages. Upon receipt of a report, the Provider is entitled to temporarily disable access to the Content and to take further actions in accordance with these Terms and applicable laws. Reports that are manifestly abusive or repeatedly unfounded may be disregarded and may result in restricted access to the reporting form.
The Provider is entitled to remove or disable access to Content if:
- a notice of rights infringement is received,
- removal or restriction is required by applicable law or a decision of a public authority,
- such action is necessary to protect the Service or its users.
7. License – Strictly Limited
7.1 The User grants the Provider a non-exclusive, limited, royalty-free license solely for the technical operation of the Service.
7.2 This license does not authorize the Provider to:
- use Content for marketing purposes,
- commercially exploit the Content,
- analyze Content,
- train artificial intelligence systems,
- perform machine learning,
- conduct data mining.
7.3 Any other use of Content is expressly excluded without the User’s prior written consent.
8. Prohibition of AI Training
8.1 The Provider:
- does not use Content for AI training,
- does not provide Content to third parties for AI-related purposes,
- does not perform automated analysis of Content beyond what is technically necessary for operating the Service.
8.2 Transfer+ is not a data collection tool for artificial intelligence.
9. Data Storage and Infrastructure
9.1 Data is stored:
- in secure cloud data centers,
- within the European Union or in compliance with EU law,
- using encryption and access control mechanisms.
9.2 The Provider:
- does not sell data,
- does not grant access to data to third parties,
- does not transfer data for marketing purposes.
10. Personal Data Protection
10.1 The Provider processes personal data in accordance with applicable legal regulations, in particular Regulation (EU) 2016/679 (GDPR).
10.2 Detailed information regarding the scope, purposes, legal bases, and rights of data subjects is provided in the separate document “Privacy Policy”, available on the Service’s website.
10.3 The Privacy Policy forms an integral part of the contractual relationship between the Provider and the User.
10.4 The Provider does not:
- sell personal data,
- provide personal data to third parties for marketing purposes,
- process personal data for AI training purposes.
11. Sanctions and Export Control
11.1 The User undertakes to comply with:
- sanctions regimes of the EU, UN, and other applicable jurisdictions,
- export control and embargo regulations.
11.2 The Service must not be used:
- by persons listed on sanctions registers,
- for transferring prohibited content,
- in violation of international restrictions.
12. Plans and Payments
12.1 The free plan may include limitations and advertisements.
12.2 Paid plans:
- are billed in advance,
- are non-refundable unless explicitly stated otherwise.
13. File Deletion
13.1 Files are stored only for:
- the duration of the link validity, or
- the period defined by the selected plan.
13.2 After expiration, files are permanently deleted and cannot be recovered.
14. Limitation of Liability
14.1 The Provider:
- does not guarantee uninterrupted availability of the Service,
- is not liable for data loss,
- is liable at most up to the amount paid by the User during the last 12 months.
15. Changes to the Terms
15.1 The Provider may amend these Terms.
15.2 Continued use of the Service constitutes acceptance of the amended Terms.
16. Governing Law
These Terms are governed by the laws of the Czech Republic.
